1) Acceptance, Updates & Eligibility
Acceptance. By using the Services, you accept these Terms and our Privacy Policy. Certain features may include supplemental terms; in case of conflict, the supplemental terms control for those features.
Updates. We may update these Terms from time to time. Material changes will be indicated by the “Updated” date above and, where appropriate, additional notice. Your continued use after changes become effective constitutes acceptance.
Eligibility. You must be the age of majority in your jurisdiction and have capacity to enter a binding agreement. You affirm that any information you submit is accurate and complete.
2) Our Services & Informational Nature
We provide an educational website, forms to request offers, and related resources for homeowners considering an as-is sale or other options. We are not a law firm, financial advisory service, or tax advisor. Content is for educational purposes only. You should obtain independent legal, tax, or financial advice before entering any agreement.

- Content, FAQs, guides, checklists, calculators, and illustrative examples
- Forms and communication tools to request callbacks or offers
- Introductions/referrals to third parties (e.g., agents, title/escrow, attorneys)
Offer availability varies by property, timeline, legal requirements, and our internal underwriting. Submitting information does not obligate you to accept an offer, nor obligate us to make one.
3) Offers, Estimates & No Guarantees
Any offer, estimate, or range we provide is non-binding until formalized in a written agreement executed by all parties. Offers may be conditioned on: title clearance; verification of property details; occupancy and access; HOA approvals; municipal requirements; and other customary items. We may withdraw or revise an offer if new information materially changes assumptions.
What to Expect
- Comparable sales with dates, distance, and condition notes
- A repair range and key assumptions used in underwriting
- Clarification of costs each party typically pays
- Realistic timelines and dependencies for closing
What Not to Expect
- Legal, tax, or financial advice
- Guaranteed outcomes or future pricing
- Title or closing services without a contracted transaction
4) Your Responsibilities
- Provide accurate, current information and update it if circumstances change
- Use the Services lawfully and in good faith
- Do not upload or transmit malware, automated scraping, spam, or unlawful content
- Respect privacy and intellectual property rights
5) Acceptable Use & Prohibited Conduct
You agree not to: (a) interfere with or disrupt the Services; (b) reverse engineer or attempt to derive source code; (c) use automated means to access or collect data (except as expressly permitted); (d) use the Services to infringe, harass, defraud, or violate law; (e) misrepresent identity or authorization; (f) copy or frame substantial portions of the Services without permission.
6) Intellectual Property
The Services, including text, graphics, logos, icons, images, video, code, and compilations, are owned by LHBUSA or its licensors and protected by copyright, trademark, and other laws. All rights not expressly granted are reserved. You may not reproduce, distribute, modify, or create derivative works except as allowed by law or with our written consent.
Trademarks. “Local Home Buyers USA” and associated marks are trademarks or service marks of LHBUSA. Third-party names and logos are property of their respective owners and used for identification purposes only.
7) User Content, Reviews & License
If you submit content (e.g., messages, reviews, testimonials, photos), you represent you have rights to do so and grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute such content in connection with the Services and marketing, subject to our Privacy Policy. We may moderate or remove content that violates these Terms or law.
8) Third-Party Links & Services
We may link to third-party websites or embed third-party content (e.g., maps, videos). Those services are governed by their own terms and privacy policies. We are not responsible for third-party content, practices, or availability.
9) Disclaimers
Informational only. THE SERVICES, INCLUDING ALL CONTENT AND ANY ESTIMATES OR TOOLS, ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LHBUSA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID (IF ANY) FOR THE APPLICABLE SERVICE DURING THE THREE MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, WHICHEVER IS GREATER.
Some jurisdictions do not allow limitations of certain damages; some limitations may not apply to you.
11) Indemnification
You agree to defend, indemnify, and hold harmless LHBUSA and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or applicable law.
12) Governing Law, Venue & Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of Minnesota, without regard to conflicts of law principles, unless the laws of your state require otherwise for consumer protection.
Informal resolution. Before filing a claim, you agree to first contact us to attempt to resolve the dispute informally within 30 days.
Arbitration; Waiver. EXCEPT WHERE PROHIBITED BY LAW, ANY DISPUTE THAT CANNOT BE RESOLVED INFORMALLY WILL BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS, AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR JURY TRIAL. Arbitration will be administered by a recognized provider under its applicable rules. This clause does not apply to claims that cannot be arbitrated as a matter of law or to claims for injunctive relief relating to intellectual property or unauthorized access.
13) Regional & Regulatory Compliance
We work with licensed title/escrow providers and attorneys where appropriate. Transactions are subject to federal, state, and local laws, including property transfer, disclosure, and consumer protection statutes. Your obligations under homeowner/condo association rules, municipal ordinances, and recorded covenants remain your responsibility unless otherwise provided in a written agreement.
Nothing in the Services replaces your duty to perform lawful disclosures or obtain independent professional advice.
14) Suspension, Termination & Survival
We may suspend or terminate your access to the Services for suspected violations of these Terms or law, or for security reasons. Sections intended to survive termination (e.g., IP, disclaimers, liability limits, indemnity, governing law) will continue in effect.
15) Miscellaneous
- Entire Agreement. These Terms and any supplemental terms constitute the entire agreement regarding the Services.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- No Waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent; we may assign them as part of a reorganization or business transaction.
- Force Majeure. We are not liable for delays or failures due to events beyond reasonable control.
